Do you think should be spanked? What about public humiliation to punish a ? As of January 2015, corporal punishment of by parents (or other adults) is banned in 44 countries. In Canada: In Canadian Foundation for , Youth and the Law v. Canada (2004) the Supreme Court upheld, in a 6-3 decision, the use of "reasonable" force to discipline , rejecting claims that moderate spanking violated 's rights. However, it stipulated that the person administering the punishment must be a parent or legal guardian, and not a school teacher or other person (i.e. non-parental relatives such as grandparents, aunts, or uncles, as well as babysitters and other caretakers, are banned from spanking); that the force must be used "by way of correction" (sober, reasoned uses of force that address the actual behaviour of the and are designed to restrain, control or express some symbolic disapproval of his or her behaviour), that the must be capable of benefiting from the correction (i.e. not under the age of 2 or over 12, etc.), and that the use of force must be "reasonable under the circumstances", meaning that it results neither in harm nor in the prospect of bodily harm. Punishment involving slaps or blows to the head is harmful, the Court held.[21] Use of any implement other than a bare hand is illegal and hitting a in anger or in retaliation for something a did is not considered reasonable and is against the law. In section 43 the Supreme Court of Canada defined "reasonable" as force that would have a "transitory and trifling" impact on the . For example, spanking or slapping a so hard that it leaves a mark that lasts for several hours would not be considered "transitory and trifling". I don't have but I did babysit my nephews and niece. I wouldn't have ever spanked them. I agree with the Canadian rules and it's not because I'm Canadian. I have heard cases of threatening their parents with getting arrested if they lay a hand on them. I feel there is something wrong with that. What do you think? Also, what do you think about public humiliation? I just read about a wearing a T-shirt that said how she got an "F" in all her courses. I personally DON'T think public humiliation is right. Do you? Elaine Shuel |

I wasn't aware that it was o.k. for a parent to hit or slap a child in Canada under any circumstances, so thanks for posting the current law. I've seen young women at Wal Mart or grocery stores literally dragging and pulling their kids, ignoring them when they speak, calling them names, or threatening them with violence when they get home. I don't have any kids either Elaine, but to me that kind of humiliation of little children is even worse than their getting a slap.

Children should not be spanked. They seem to have enough to endure

To me punishing a child in public is like a husband berating his wife in a public place.... is considered both mental & physical abuse & a huge embarrassment to yourself, whoever is being abused and the people around you. However, I do believe in spanking (under very legitimate circumstances). Having said this, I actually overheard a teenager (in a huge mall) telling his mom to F--- off.... I was appalled...makes one wonder about the home environment. I brought up a teen myself and no way did he ever disrespect me, nor I him.... neither was I ever disrespected by my late hubby.

Thanks so much for sharing all that with us, Lucas. Clearly the subject means a lot to you and frankly, a lot to me. I really do agree with the Canadian laws. I think spanking is fine but only if it helps make the child do better next time. It shouldn't be done to make it easier on the parents. It shouldn't be hard enough to leave a scar and should only be done with bare hands and on the rear. That said, I never had kids so I hope others don't think I don't have a right to my opinion. Welcome to my blog,IMCoach1949. My brother was spanked once in his life, while my sister and I were regularly spanked because we shared a room and talked before bed. We all respect others but my brother didn't teach his kids to say thank you and appreciate things. That bothers my sister and I. Was that related to getting spanked? I don't think so. That said, spanking shouldn't be done regularly and I don't believe in the use of straps or other objects ever. Elaine Shuel

When I was a child growing up, had my Mother heard me say some of things that are said here by certain bloggers, she would have tanned my butt with a elm switch. It was hard fast rule that you did NOT call people stupid, ignorant, or any other derogative name. Elaine Shuel

Welcome to my blog, grandaddy_3. I'm surprised to hear that the Principal spanked you. They didn't do that where I lived. I really do believe that using belts and hitting someone's head isn't the best way to discipline. It may have worked in your case but it could cause harm for others. Thanks for your comment. Thanks ET. I agree that a light spanking with the hand on the rear, won't hurt anyone. It shouldn't be a regular thing though. It also depends on if it makes the child change his poor behavior. I was disgusted, when I read an article about a child threatening to call the police if he got a spanking. To me, that was a sign that the laws there went too far. Elaine Shuel
