Investigation finds massive wrongdoing by the prosecutor in the case against the ex-Missouri governor

St. Louis prosecutor Kimberly Gardner engaged in 62 acts of misconduct that resulted in 79 false representations during the prosecution of Eric Greitens, the memo alleges

Missouri's chief legal disciplinary officer accused St. Louis' top prosecutor of sweeping misconduct in the failed prosecution of former Gov. Eric Greitens, saying she lied to judges in court filings and testimony, withheld exculpatory evidence from the defense, misled her own prosecution team, and violated the constitutional right to a fair trial.

St. Louis Circuit Attorney Kimberly Gardner, one of the early local prosecutors bankrolled by liberal megadonor George Soros since 2016, engaged in 62 acts of misconduct that resulted in 79 false representations during Greitens' now-dismissed criminal prosecution, according to Chief Disciplinary Counsel Alan Pratzel's memo obtained Wednesday by Just the News.

"Probable cause exists to believe that the respondent is guilty of professional misconduct," Pretzel declared in a 73-page memo that repeatedly accused Gardner of withholding evidence of innocence and providing a false portrait to the courts, the defense, and even her own prosecution team.

Pretzel also accused Gardner of lying during the disciplinary proceedings, long after the case was dismissed against Greitens, a former Navy SEAL and rising Republican star who was forced to resign as governor in 2018 less than after he was sworn in.

The disciplinary action against Gardner follows the 2019 indictment of her former chief investigator in the case, ex-FBI agent William Tisaby, on seven felonies alleging he committed perjury and evidence tampering during the Greitens probe.

Gardner also remains under criminal investigation by a special prosecutor as Tisaby awaits a trial that has been delayed by the COVID-19 pandemic.

The unraveling of the criminal case was highlighted in a Just the News investigative report last year, prompting some to compare Gardner's actions to the FBI's now-confirmed misconduct during the pursuit of then-President Donald Trump during the Russia collusion probe.

Pretzel concluded that Gardner had violated her responsibilities as a lawyer and a prosecutor, essentially suborning Tisaby's perjury by "failing to take reasonable remedial measures when she knew Tisaby was giving false answers to questions."

"She offered and elicited false testimony when questioning Tisaby" during a deposition ordered by the court and also provided inaccurate information to a fellow prosecutor during a private session in the judge's chambers that later led that prosecutor to make false statements to the court, the memo alleged.

Gardner, St. Louis's first black chief prosecutor, filed an initial response to the allegations, suggesting race and politics were involved in the disciplinary action but acknowledging she made mistakes in the Greitens prosecution.

"In hindsight, were each and every one of Ms. Gardner's actions in the intense, fast-paced Greitens investigation and prosecution perfect? No, but that is not the measure or purpose of the attorney discipline," her legal team wrote.

She claimed that she has been the "target" of attacks for her "tireless and courageous efforts to reform the criminal justice system" and was being treated differently compared to other lawyers.

"Attacks on Ms. Gardner have taken many forms, ranging from overtly racists emails sent to her office to investigations and lawsuits against her," her reply alleged. She also showed her continued disdain for Greitens, calling him a Republican "golden boy."

Gardner has been the object of frequent controversy and criticism, including as the focus of an ongoing special prosecutor's criminal investigation in the Greitens case, and was recently removed by a court in the prosecution of a St. Louis couple accused of brandishing weapons during last year's Black Lives Matter protests.

She has frequently used race as a defense, even filing a lawsuit under the Ku Klux Klan Act of 1871 last year alleging the St. Louis police union had mobilized to thwart her efforts to reform criminal justice and denouncing the "white, ethically conflicted special prosecutor" investigating her and Tisaby. That lawsuit was thrown out last September.

Pretzel's memo, however, provides the most direct and serious threat to her hold on the St. Louis prosecutor's office. Disciplinary action, if upheld by a hearing panel and the Missouri Supreme Court, could range from public admonishment to loss of her law license, the latter of which could end her tenure as circuit attorney.

The disciplinary memo cited a litany of violations of rules designed to ensure ethical behavior by lawyers and prosecutors and fair trials for defendants. It alleged she made false statements in court filings, engaged in "conduct prejudicial to the administration of justice" and harmed Greitens' right to a fair trial by keeping required evidence of innocence from the defense.

Gardner violated "the rules of criminal procedure and court orders by concealing discoverable and exculpatory evidence," the memo stated.

St. Louis Circuit Attorney Kimberly Gardner could face penalties ranging from admonishment to law license revocation.

In an extraordinary turnabout, a George Soros-backed prosecutor in St. Louis was ordered Tuesday to face a professional disciplinary hearing over her conduct in pursuing now-withdrawn criminal charges against former Republican Missouri Gov. Eric Greitens.

The Missouri Office of the Chief Disciplinary Counsel found probable cause that St. Louis Circuit Attorney Kim Gardner committed professional misconduct and should face a disciplinary hearing, according to records posted Tuesday evening by the Missouri Office of the Advisory Committee and Legal Ethics Counsel.

The proceeding now goes to a disciplinary hearing panel for decision on a possible penalty, which would then be imposed by the Missouri Supreme Court. Gardner will be able to defend herself at the hearing.

"All disciplinary hearing panel cases are filed with the Supreme Court of Missouri unless they are dismissed at the disciplinary hearing panel level or if the disciplinary hearing panel administers a written admonition that is accepted by the Chief Disciplinary Counsel and the Respondent," according to the state's rules.

Discipline can range from admonishment to the revocation of Gardner's law license. The order was based on a complaint filed by Greitens' attorneys more than a year ago. Greitens recently announced he is planning a political comeback, running for the open Senate seat in Missouri.

The supporting findings and complaint of the disciplinary counsel against Gardner were not immediately made public, and Just the News filed a request Tuesday evening with the disciplinary office to release those records.

The order Tuesday is the latest fallout from the decision by Gardner, a Democrat, to file criminal charges against Greitens, a Republican, in 2018 alleging that he used a cell phone picture of a girlfriend to make extortion threats.

Gardner was forced to withdraw the charges after admitting she did not have the evidence to substantiate them, leading to a dismissal of the case. But by that time, Greitens had been forced to step down, as chronicled by a Just the News investigation last year.

Gardner was among the first local prosecutors to be funded heavily by liberal megadonor George Soros' Missouri Justice & Public Safety PAC, becoming St. Louis' first black chief prosecutor in 2016. Soon, she would be mired in controversy over her confrontations with police over reform, her failed prosecution of Greitens and her recent efforts to charge a St. Louis couple with gun brandishing during last summer's protests.

She easily won reelection last year, but her legal troubles have are far from over. Her former chief investigator in the Greitens case, a former FBI agent named William Tisaby, has been indicted on seven felonies for misconduct in the prosecution and is awaiting trial. And Gardner herself is being investigated by a special prosecutor for her handling of the Greitens case.

Anti-Asian violence in New York right now is more than random street-corner sucker punches and terrifying subway shoves. It’s also the deliberate disassembly of meritocratic public education under the guise of ethnic equity — a dagger to the heart of the fastest-growing and arguably most dynamic immigrant group in the city.

Not to diminish the thuggery, the most serious threat to Asian American New Yorkers is the Department of Education’s ill-disguised effort to eliminate merit test-based admission to the city’s eight highly selective high schools. The process is dominated by Asian to the virtual exclusion of Black and Hispanic students.

The new numbers came out last week, and they are beyond harsh: Asians won 54 percent of this year’s freshman class seats; whites, 28 percent; Hispanics, 5 percent, and African Americans, 4 percent.

Whereupon Schools Chancellor Meisha Ross Porter demanded an end to test-based admissions — because "It’s far past time for our students to be fairly represented."

Weird. By her own words, Porter doesn’t consider Asian — apparently all 5,000 of them — to be among "our students." And to her, "fair representation" means quotas. How else to interpret what she said?

But only rarely is the official agenda so clearly — if perhaps inadvertently — stated: Explicitly expelling Asian from the "our students" mix is both breathtaking and a fair measure of how far off the rails public education policy is in New York these days.

If the pandemic has produced anything positive, it is now beyond argument that teachers as an organized force have no interest in actually teaching; hell, they’re no longer even going through the motions.

Neither is Porter, obviously, nor de Blasio, Cuomo, the state and city education departments, the City Council, the Legislature and the state Board of Regents — the last once being America’s most demanding monitor of quality public schools.

The rationale was simple: A solid basic education was intrinsically a good thing, but transforming the nation’s immigrant legions into an educated workforce would promote prosperity, too.

That worked for decades — but over time, the assumption frayed. Now the game is Porter’s quota culture — and those running it admit to no distinction between pretending to educate and actually doing so.

And they hope nobody notices; so far, nobody has.

Yet those high school admissions numbers are hard to miss — and it’s a safe bet that the city’s Asian Americans are staring at them intently.

Certainly, the city itself is changing. Where things will stand when the pandemic shakes out is anybody’s guess. Plus those 2020 Census Bureau numbers released last month bear close study.

But no one will dispute that immigration once again is radically transforming the five boroughs. To the point, Brooklyn’s Sunset Park and Flushing/Elmhurst in Queens have been transformed by Chinese newcomers — most poor but tirelessly striving and virtually all dedicated to advancement through high-quality, merit-driven education.

Hard work and familial support make for exemplary test scores — so it is no accident that immigrant make up a significant percentage of those Porter and her quota cabal would turn away from the city’s specialized high schools.

And while neighborhoods like Park Slope and the Upper West Side get most of the attention when the elimination of programs for talented is being discussed, don’t think for a minute that extra effort for high-performing outer-borough Asian isn’t on the target list too.

Still, Park Slope and Upper West Side residents often have options not available to impoverished, often illegal immigrants from, say, mainland China’s Fujian Province. The question is how hard they’ll push back against Porter’s blatant discrimination.

It wouldn’t be the first time that a demand for quality public schools created social and political friction in the city — that is to say, generated the sometimes-disruptive energy necessary for positive change.

Porter would do better to concentrate on the reasons underlying Black under-performance — they are many, varied and often heartbreaking — rather than trying to mask those problems with quotas.

They won’t help Black learn, after all, and isn’t that supposed to be the point?
